These Terms and Conditions (“Terms”) govern the use of services provided by ECV (PTY) LTD (“ECV,” “we,” “our,” or “us”). By engaging our services, you (“Client,” “you,” or “your”) agree to comply with and be bound by these Terms. Please read them carefully before proceeding.



1. Scope of Services

ECV provides specialist services in:

  • Short-term insurance claim investigations
  • Accident reconstruction and analysis
  • Fraud detection and prevention
  • Claim verification and validation
  • Expert reporting and testimony for litigation

All services are provided in accordance with South African laws and industry standards. The specific scope of work will be outlined in a formal agreement or service-level contract between ECV and the Client.


2. Acceptance of Terms

By engaging our services or accessing our reports, you:

  • Confirm that you are legally authorized to act on behalf of the business or individual represented.
  • Acknowledge that you have read, understood, and agreed to these Terms.
  • Agree to abide by any additional terms specified in service agreements or invoices.

3. Client Obligations

The Client is responsible for:

  • Providing accurate and complete information relevant to the investigation or reconstruction.
  • Ensuring that all requested documentation is submitted promptly to prevent delays.
  • Informing ECV of any changes or developments that may affect the investigation.
  • Complying with applicable laws when sharing personal or sensitive data.

Failure to provide accurate information may result in incomplete or inaccurate findings, for which ECV will not be held liable.


4. Fees and Payment

  • Service fees will be outlined in a quotation or service agreement provided prior to the commencement of work.
  • Payment terms are strictly [Insert Payment Terms, e.g., 30 days from date of invoice].
  • Late payments may result in additional charges or suspension of services.
  • All fees are exclusive of VAT unless otherwise stated.

5. Confidentiality

  • ECV maintains strict confidentiality regarding all investigations and client information.
  • Reports and findings are provided solely for the Client’s internal use and may not be shared with third parties without written consent.
  • Both parties agree to take reasonable steps to safeguard confidential information.

6. Limitation of Liability

  • ECV conducts investigations and reconstructions using professional expertise and reasonable care.
  • However, ECV does not guarantee specific outcomes and will not be liable for any indirect, incidental, or consequential damages resulting from the use of our services.
  • Our liability, if any, shall be limited to the total amount paid by the Client for the specific service rendered.

7. Data Protection and Privacy

  • ECV complies with the Protection of Personal Information Act (POPIA).
  • Personal data collected during investigations will only be used for purposes directly related to the services provided.
  • Clients are responsible for obtaining necessary consent from individuals whose data is shared with ECV.

8. Intellectual Property

  • All reports, findings, and related documentation prepared by ECV remain the intellectual property of ECV until full payment has been received.
  • Clients are granted a non-exclusive, non-transferable license to use the reports solely for the purpose outlined in the service agreement.

9. Termination of Services

  • Either party may terminate the service agreement by providing written notice.
  • The Client will be responsible for all costs incurred up to the termination date.
  • ECV reserves the right to terminate services immediately in cases of non-payment or breach of these Terms.

10. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa. Any disputes shall be resolved in South African courts of competent jurisdiction.


11. Amendments

ECV reserves the right to update or modify these Terms at any time. Clients will be notified of any material changes, and continued use of services constitutes acceptance of the revised Terms.
